Terms of Service

1. Agreement and eligibility

By creating an account, downloading our apps, or using the Service, you agree to these Terms and our Privacy Policy. You must be at least 13 years old (or the minimum age in your jurisdiction) and able to form a binding contract.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of the Service

BabbleFlow enables you to capture speech on a supported mobile device, upload audio for cloud transcription (including optional translation and template-based formatting), store results, and optionally send text to a linked Windows computer via BabbleFlow Link.

Features, languages, retention limits, and availability may change. We do not guarantee uninterrupted or error-free operation.

3. Accounts and authentication

Some features require an account. You are responsible for safeguarding your credentials and for activity under your account.

You must provide accurate information and notify us of unauthorized access. We may suspend accounts that appear compromised or abusive.

4. Subscriptions, billing, and free-tier limits

Paid plans and in-app purchases, where offered, are billed through the applicable app store or payment provider under their terms. Pricing, renewal, and cancellation are disclosed at purchase.

Free or trial tiers may include limits on recording duration, concurrent jobs, storage slots, or features. We may change limits with reasonable notice where required by law.

5. Acceptable use

You agree not to misuse the Service. You must not:

• Record individuals without consent or other legal right where required by law
• Upload unlawful, infringing, harassing, or highly sensitive content without appropriate authority and safeguards
• Attempt to probe, scan, or compromise our systems or other users’ accounts
• Reverse engineer, scrape, or resell the Service except as permitted by law
• Circumvent usage limits, entitlements, or security controls
• Use the Service in a manner that violates applicable law or third-party rights

5a. Professional use

You are solely responsible for how you use transcripts, including in professional, healthcare, or legal contexts. BabbleFlow is not a substitute for professional judgment or compliant record-keeping where those apply.

6. Your content and license

You retain ownership of audio, transcripts, and other content you submit (“User Content”).

You grant us a worldwide, non-exclusive license to host, process, transmit, display, and otherwise use User Content solely to operate, provide, and improve the Service, including transcription, storage, support, and paste delivery to devices you link.

7. Intellectual property

BabbleFlow, its logos, software, and documentation are owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you rights to our trademarks or brand except as needed to use the Service.

8. Third-party services

The Service may integrate with third-party platforms (such as app stores, sign-in providers, or cloud infrastructure). Your use of those services is subject to their terms and policies.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Automated transcription, translation, and summarization may contain errors. You should review outputs before relying on them for important decisions.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (USD $50), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

11. Indemnity

You will defend and indemnify us against claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or willful misconduct.

12. Suspension and termination

You may stop using the Service at any time and may delete your account where the app provides that option.

We may suspend or terminate access if you violate these Terms, create risk for us or others, or where required by law. Upon termination, your right to use the Service ends; sections that by nature should survive will survive.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which BabbleFlow operates, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.

Disputes should first be raised through our support channels. Where permitted by law, courts in our principal place of business have exclusive jurisdiction, unless local law grants you the right to bring claims in your home jurisdiction.

14. Changes to these Terms

We may modify these Terms from time to time. We will post updates on this page with a revised “Last updated” date. Continued use after changes become effective constitutes acceptance, except where additional consent is required by law.
